What is Section 482 CrPC?
Section 482 of the Code of Criminal Procedure, 1973 recognises the inherent powers of the High Court to prevent abuse of the process of any court or to secure the ends of justice. This is one of the most powerful remedies available to a person facing false or frivolous criminal proceedings. The High Court can quash an FIR, a charge sheet, or even ongoing criminal proceedings if they are manifestly unjust.
Grounds for Quashing
The Supreme Court in State of Haryana v. Bhajan Lal laid down seven categories where criminal proceedings can be quashed: the allegations do not disclose a cognizable offence; the allegations are absurd and improbable; there is no legal evidence to support the charge; the proceedings are malicious and instituted with ulterior motives; the complaint is barred by law; the allegations prima facie do not constitute any offence; or the criminal proceeding is an abuse of the court process.
When to File a Quashing Petition
A quashing petition can be filed at any stage: before charge sheet is filed, after charge sheet but before framing of charges, or even during trial. However, the earlier you file, the better your chances. Filing at the FIR stage prevents harassment of investigation. Filing after charges are framed is more difficult as the court has already found prima facie case.
The Process
