Consumer Rights in India: How to File a Case in Consumer Court

The Consumer Protection Act, 2019, gives every Indian consumer powerful rights against defective goods and deficient services.

What is a Consumer Complaint?
A consumer complaint can be filed against:

  • Defective goods (faulty products, expired items)

  • Deficient services (poor work, delayed service)

  • Unfair trade practices (misleading ads, false claims)

  • Unfair contracts (one-sided terms)

Three-Tier Consumer Court System

  • District Consumer Disputes Redressal Forum (DCDRF): Claims up to ₹50 lakh

  • State Consumer Disputes Redressal Commission (SCDRC): Claims ₹50 lakh to ₹2 crore

  • National Consumer Disputes Redressal Commission (NCDRC): Claims above ₹2 crore

How to File a Complaint

  • Gather all documents (bills, invoices, correspondence)

  • Send a legal notice to the opposite party

  • File a complaint within 2 years of the cause of action

  • Pay nominal court fees (varies by jurisdiction)

Documents Required

  • Proof of purchase (bill, invoice, receipt)

  • Warranty/guarantee card

  • Correspondence with the seller/service provider

  • Evidence of deficiency (photos, expert reports)

  • ID proof of the complainant

What Relief Can You Get?

  • Replacement of defective goods

  • Refund of money paid

  • Compensation for loss or injury

  • Litigation costs

Common Consumer Cases Won

  • Insurance claim repudiation overturned

  • Builder delays and defective construction

  • Defective vehicles and electronic goods

  • Medical negligence compensation

Time Limit for Filing
Generally 2 years from the date of the cause of action, though the court may condone delay with sufficient cause.

Don't let unfair practices go unchallenged. Consumer courts in India are consumer-friendly and don't require a lawyer for small claims.
